Probate can be tricky if you don’t know what you’re doing. Selling a house in probate is also something that hits close to home for me and while I am not a legal expert, I can certainly speak with some experience on the subject, having gone through this experience, first hand.
Three years ago, my mother passed away unexpectedly at her home. It was devastating. It was confusing. And she died intestate, meaning she died without a will. What this meant was that if she had a will or a trust, we would simply be executing her wishes to distribute her possessions and property as she had wished, but since she didn’t, we would now have to go through the probate process. One of the first things we did was to petition the court to become administrators, allowing us to make joint decisions. This now meant that everything would be split 50/50 with my sibling. We would also have to sell my mothers house. The house had a reverse mortgage on it and the amount that was owed was subsequently half the value of the house. Because we didn’t have the money to pay off the reverse mortgage before probate was settled, the only choice we had was to sell it. We didn’t know all of our options at the time so we went through a Realtor.
Also during that time I was studying for the Real Estate Exam but lacked the savvy to navigate a transaction such as the sale of my mothers’ house without a Realtor. I didn’t know I could have sold this beautiful Southern California probate property to a cash buyer or buy my sister out without giving away thousands in commission fees. Looking back, this process could have been so much easier but that’s because I didn’t know what I know now. Only if I had someone like myself to inform me of my options, I could have sold it to a buyer in “as is” condition and saved thousands in commissions as well as the money it took to fix it up. Out of pocket expenses to fix up the house in order to get the buyer to finalize escrow was the most stressful and inconvenient of all.
